These Terms and Conditions govern the use of the Luppa service operated by Luppa.pro. By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing, browsing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to these Terms.
If you do not agree to these Terms, you must not use the Service.
2. Description of Service
Luppa provides an AI-assisted information and guidance service relating to construction, permits, planning, regulations, public authority guidance, municipal requirements, and related matters.
The Service may utilize artificial intelligence, machine learning systems, publicly available information, third-party data sources, municipal guidance, legislation, regulations, and other materials.
The Service is intended solely as an informational tool.
3. No Professional Advice
The Service does not provide legal advice, engineering advice, architectural advice, planning advice, surveying advice, permit approval, regulatory interpretation, or any other professional advice.
Information provided through the Service is for informational purposes only and must not be considered a substitute for professional advice or official authority guidance.
No response, output, recommendation, summary, analysis, classification, or statement generated by the Service shall create any professional-client relationship between Luppa.pro and the user.
4. User Responsibility for Verification
Luppa is intended to assist users in finding and understanding information. Luppa does not replace official laws, regulations, municipal guidance, authority decisions, permit requirements, professional advice, or direct communication with the relevant authority.
Before submitting permit applications, commencing construction, purchasing property, making investments, entering into contracts, or taking any other action based on information obtained through the Service, the user must independently verify the information from the original source documents and, where necessary, directly with the relevant authority or qualified professional.
The user accepts full responsibility for any decisions, actions, omissions, costs, delays, damages, penalties, or other consequences arising from the use of or reliance upon the Service.
5. Third-Party Sources
The Service may utilize, reference, index, process, summarize, analyze, or otherwise make use of publicly available information, legislation, regulations, government publications, municipal guidance, planning materials, technical standards, and other third-party content.
All ownership rights in such content remain with their respective owners.
Luppa.pro makes no representations regarding the completeness, availability, accuracy, or continued availability of third-party content.
6. User Accounts
Users are responsible for maintaining the confidentiality of their account credentials.
Users are responsible for all activities occurring under their accounts.
Users must immediately notify Luppa.pro of any unauthorized access or security breach.
7. User Content and License Grant
Users may submit information, prompts, documents, drawings, plans, messages, data, and other materials through the Service ("User Content"). Users retain ownership of their User Content.
To the fullest extent permitted by applicable law, users grant Luppa.pro a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable, and unrestricted license to use, store, process, copy, modify, analyze, reproduce, distribute, commercialize, and create derivative works from User Content for any lawful business purpose.
Such purposes include operating the Service, improving the Service, developing new products and services, analytics, research, business operations, commercialization, and artificial intelligence development.
User Content may be used for training, retraining, fine-tuning, evaluating, testing, improving, and developing artificial intelligence systems, machine learning models, language models, datasets, algorithms, and related technologies.
Users acknowledge that User Content may become incorporated into model training datasets, model parameters, embeddings, machine learning artifacts, and derivative technologies.
Luppa.pro is not obligated to identify, remove, or reverse any influence User Content may have on such systems.
Any suggestions, ideas, comments, corrections, feature requests, or feedback submitted to Luppa.pro may be used by Luppa.pro without restriction, attribution, or compensation.
Users are not entitled to compensation, royalties, revenue sharing, or any other consideration arising from Luppa.pro's use of User Content, Feedback, or derivative works.
8. Ownership of Service and Knowledge Base
The Service, including its software, databases, knowledge structures, knowledge graphs, prompts, workflows, metadata, retrieval systems, classifications, taxonomies, user interfaces, documentation, outputs, and related intellectual property are owned by Luppa.pro or its licensors.
The selection, collection, organization, categorization, indexing, enrichment, structure, relationships, metadata, retrieval systems, databases, knowledge graphs, prompts, workflows, and other components of the Service constitute proprietary intellectual property of Luppa.pro, even where underlying source materials are publicly available.
Any aggregated, anonymized, derived, analytical, statistical, synthetic, machine-generated, or transformed data created through the operation of the Service shall belong exclusively to Luppa.pro.
9. Acceptable Use
Users shall not violate applicable laws; submit unlawful, infringing, fraudulent, or harmful content; interfere with the operation of the Service; attempt unauthorized access to systems or data; reverse engineer the Service except where expressly permitted by law; systematically extract, scrape, harvest, mirror, download, reproduce, or copy substantial portions of the Service; or use the Service or its outputs to create, train, improve, or support competing products, databases, search engines, AI systems, or services.
10. Service Availability
The Service is provided on an "as is" and "as available" basis.
Luppa.pro does not guarantee uninterrupted availability, error-free operation, availability of specific features, or compatibility with any specific purpose.
Luppa.pro may modify, suspend, restrict, or discontinue any part of the Service at any time without liability.
11. Disclaimer of Warranties
To the maximum extent permitted by law, Luppa.pro disclaims all warranties, whether express, implied, statutory, or otherwise.
Luppa.pro does not warrant that any information, recommendation, guidance, interpretation, analysis, response, or output provided through the Service is accurate, complete, current, reliable, suitable, or fit for any particular purpose.
12. Limitation of Liability
To the maximum extent permitted by law, Luppa.pro and its officers, directors, employees, contractors, affiliates, licensors, and partners shall not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or economic damages.
This includes loss of profits, revenue, business opportunities, permits, contracts, property value, goodwill, data, or anticipated savings.
Luppa.pro's total aggregate liability arising out of or relating to the Service shall not exceed the amount paid by the user to Luppa.pro during the twelve (12) months preceding the event giving rise to the claim, or one hundred (100) euros if no fees were paid.
13. Indemnification
Users agree to defend, indemnify, and hold harmless Luppa.pro from any claims, liabilities, damages, losses, costs, and expenses arising from User Content, violation of these Terms, misuse of the Service, or violation of applicable laws or third-party rights.
14. Termination
Luppa.pro may suspend or terminate access to the Service at any time, with or without notice, for any reason.
Termination shall not affect rights or obligations that by their nature survive termination.
15. Privacy
The processing of personal data is governed by Luppa's Privacy Policy.
In the event of any conflict between these Terms and the Privacy Policy regarding personal data processing, the Privacy Policy shall prevail.
16. Changes to Terms
Luppa.pro may modify these Terms at any time.
Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
17. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Finland, excluding its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall be resolved by the competent courts of Finland, unless mandatory law requires otherwise.
